General Terms and Conditions Declaration of Applicability

These General Terms and Conditions apply to all offers from, orders from and agreements with LS. The conditions have been drawn up in accordance with the latest known laws and regulations of the EU and the Netherlands. By placing an order, the customer agrees to all these conditions including the privacy and cookie policy . Deviations are only valid if agreed in writing.
LS has the right to change these terms and conditions at any time.
The General Terms and Conditions are accessible to everyone and are included on the LS website. Upon request, you will receive a copy by email.

General Terms and Conditions Prices and conditions

All prices are in Euros and include VAT, excluding shipping costs.
All wines from LekkerSapje.nl are covered by our 100% Lekker Guarantee (see Customer Service - 100% Lekker Guarantee). Here you will also find information about cancelling an order (right of withdrawal).
The following applies regarding reimbursement :
LS will reimburse all your payments, including any delivery costs charged by LS for the returned wine(s), without undue delay but within 14 days following the day on which you report the withdrawal. Unless LS offers to collect the product itself, LS may withhold reimbursement until LS has received the wine(s) back in good order or until you demonstrate that you have returned the wine(s). LS will use the same payment method for reimbursement that you used, unless you agree to a different method. The reimbursement is free of charge for you.

Unless otherwise stated, the content of wine bottles is 0.75 litres.

LS does not sell alcohol to persons under the age of 18. By placing an order, the purchaser declares to be at least 18 years of age or older. In order to be able to order, you must therefore be 18 years of age or older. Upon delivery, you must be able to demonstrate this if requested.
The deliverer of your order may ask you to prove that you are 18 years or older. You can prove this with a passport, driver's license or identity card.

You can choose how you want to pay when ordering. You pay safely via iDEAL, via bank transfer or via various other payment methods such as credit card. After receipt of payment your order will be shipped.

Delivery

If your order is received before 16:00, it will normally be delivered to the specified address or nearest pick-up point within 2-5 business days. LS is not liable for damages resulting from exceeding delivery times.

If you order for more than €95,- incl. VAT, delivery in the Netherlands is free . If you order for less than €95,- the contribution to the shipping costs is €8.50. For Belgium there is always a contribution of €12.95.
All offers from LS are without obligation. If a wine is unexpectedly or unexpectedly no longer available, we will contact you. If desired, we will then offer you an alternative or we will return your payment within 21 days.

The images of bottles or labels and the years visible on them on the website may differ from the delivered bottles. The wine description states the currently available year. LS reserves the right to deliver wine from a subsequent year if the desired year is no longer available. You will of course be notified of this.

Delivery to other European countries than the Netherlands and Belgium can be arranged on request. The delivery costs are of course higher and the delivery time is longer. Ask for the possibilities by email.

The risk during the transport of the goods (wines) ordered by you is for LS. At the moment of delivery, or the moment that can reasonably be considered as delivery, the risk of the product (wine) passes to you (the buyer), except for the liabilities that cannot be excluded by law by LS.

If a bottle is broken or missing, please note the number of broken and/or missing bottles on the shipping documents or with the carrier and contact us as soon as possible at lekker [at] lekkersapje [dot] nl stating your order number.

Force majeur

LS is not obliged to fulfil any obligation if LS is prevented from doing so as a result of a circumstance that is not its fault, nor for which it is responsible under law, legal act or generally accepted views. These circumstances include weather alerts, business disruptions, disruptions in internet connections, transport delays, strikes and failure or untimely delivery by suppliers to LS.

Complaints

If you have a complaint, you can report this via lekker [at] lekkersapje [dot] nl. LS will try to resolve this complaint as soon as possible and will then inform you of this immediately. You will receive a message within 7 days. If you are not satisfied with the handling of your complaint, you can submit this to the Disputes Committee up to 1 year after submitting your complaint to LS.

Protection of personal data

The personal data entered when placing an order will be stored in a data file. This data will be used to process the order and to contact the customer.
The data provided to LS for receiving mailings etc. will never be sold or rented by LS to third parties. If you want to be removed from our e-mail file, you can send an e-mail to mailingbestand [at] lekkersapje [dot] nl after which your address will be removed from our file. You will also receive a confirmation of this. If you want to know what data LS has about you, you can also request this by e-mail and have it adjusted.

By placing an order, you (the customer) expressly agree to these general terms and conditions and to the privacy and cookie policy.

Website

The website has been compiled with the utmost care, but inaccuracies may occasionally occur. For example, due to typing errors. LS accepts no liability for any consequences of unexpected inaccuracies on this website. LS also accepts no liability in the event of malfunctions, interruptions or other causes that lead to delays in the provision of information and/or delivery times.

LS reserves the right to change the rules and conditions regarding access to the use of the website without prior notice. LS also reserves the right to subject the website or parts thereof to restrictions.

Access to closed or private areas of the website is dependent on the provision of information by the visitor to the website. This visitor expressly agrees that this information becomes the property of LS and that LS is given express permission to use this information in accordance with the privacy policy of LS.
Access to closed or private areas of the website by means of usernames and passwords can be changed or refused by LS at any time without this giving rise to any right to compensation.

Reviews

We collect reviews about our services via the platform of customers tell (Kiyoh). All reviews are checked for authenticity, in accordance with EU legislation. This way you can be sure that the reviews you read here come from real customers. After purchase, we invite all our customers to leave a review.
If it is not certain that a review comes from a customer who has purchased something, customers tell asks for proof of purchase. This is how we prevent fake reviews. If a review was placed after products or services were delivered for free or there was a paid collaboration, this is clearly stated. Intellectual property

The intellectual property rights and all copyrights of the LS website, including the design of the website, all texts, logos, photos and images, are the sole property of LS. Copying or processing thereof in whole or in part without prior written permission from LS is not permitted and is an infringement of the above-mentioned rights.

General Terms and Conditions Applicable law

All offers and agreements of LS are exclusively subject to Dutch law. Disputes will be submitted to the competent court in The Hague/Leiden.
